Release of Liability, Assumption of Risk & Cancellation Policy
Please read this document carefully and ensure that you understand its contents before confirming your participation in any activity organized by Grasp the Adventure LLC.

Release of Liability, Waiver of Claims, Assumption of Risk & Indemnity Agreement

In consideration of the services provided by Grasp the Adventure LLC, its directors, employees, contractors, volunteers, activity leaders, guides, representatives, and affiliates (collectively referred to as "Grasp the Adventure"), I hereby agree to release, discharge, and hold harmless Grasp the Adventure on behalf of myself, my children, my heirs, assigns, personal representatives, and estate as follows:

Acknowledgement of Risk

By agreeing to these Terms & Conditions, I acknowledge that I have been informed of and understand the inherent hazards and risks associated with adventure activities organized by Grasp the Adventure, including travel to and from activity locations.

I acknowledge that outdoor adventure activities involve inherent risks that cannot be completely eliminated, regardless of the experience, training, or qualifications of event leaders, guides, or instructors. 



I understand that trekking, hiking, backpacking, canyoning, climbing, camping, mountaineering, water-based activities, and other adventure sports involve known and unforeseen risks that may result in physical injury, emotional injury, illness, paralysis, permanent disability, death, property damage, or other losses.

I further acknowledge that many Grasp the Adventure activities take place in remote locations where access to emergency services, medical facilities, communications, rescue services, and evacuation may be delayed, difficult, or unavailable.

Risks Include, But Are Not Limited To

The hazards and risks include, but are not limited to:

  • Injury resulting from participation in activities, including permanent disability or death
  • Falls resulting in broken bones, severe injuries to the head, neck, spine, limbs, or other parts of the body
  • Altitude-related illnesses including Acute Mountain Sickness (AMS), High Altitude Pulmonary Edema (HAPE), High Altitude Cerebral Edema (HACE), hypothermia, and other cold-related conditions.
  • Slips, trips, falls, and injuries caused by uneven terrain, loose rocks, cliffs, steep slopes, water crossings, and natural obstacles.
  • Being struck by falling rocks, debris, equipment, or other participants.
  • Equipment malfunction or failure, despite inspection and reasonable precautions.
  • Cuts, abrasions, rope burns, and injuries associated with climbing, scrambling, canyoning, and other technical activities.
  • Exposure to extreme weather conditions, including heat, cold, wind, rain, storms, lightning, flooding, and other natural hazards.
  • Heat exhaustion, heat stroke, dehydration, and sun-related injuries
  • Fatigue, dizziness, exhaustion, reduced reaction times, or impaired judgment.
  • Encounters with wildlife, animals, insects, reptiles, marine life, or plants.
  • Risks associated with transportation arranged, coordinated, recommended, or utilized in connection with an event.
  • The negligence of other participants or third parties
  • My own negligence, actions, omissions, decisions, or failure to follow instructions
  • Any other known, unknown, foreseeable, or unforeseeable risks associated with outdoor adventure activities.
I understand that the above list is not exhaustive and that unknown or unanticipated risks may result in injury, illness, disability, death, or property damage.

Participant Responsibilities

I acknowledge my responsibility to contribute to the safety of myself and others by following all instructions provided by Grasp the Adventure and by adhering to the following rules throughout the activity:

  • Do not leave the designated route or activity area without approval from a Grasp the Adventure representative
  • Do not proceed ahead of the designated lead guide or activity leader.
  • Do not fall behind the designated sweeper or designated group representative
  • Do not stop or separate from the group without notifying a Grasp the Adventure representative
  • Do not begin the activity without the minimum required water, equipment, clothing, or safety gear communicated by Grasp the Adventure.
  • Do not sit, rest, place hands, or otherwise make contact with rocks, vegetation, water, or other natural elements without exercising reasonable caution and awareness of potential hazards.

I understand that these rules reduce, but do not eliminate, the risk of injury, illness, or death.

I acknowledge that additional activity-specific safety instructions may be provided before or during an event and agree to comply with all such instructions.

Medical Fitness Declaration

I certify that I am physically and medically fit to participate in the activity and do not suffer from any medical condition that would make participation unsafe for myself or others.

I understand that it is my responsibility to consult a medical professional if I have any concerns regarding my health, fitness, medications, or ability to participate safely.

I acknowledge that Grasp the Adventure does not provide medical assessments and relies on my own declaration regarding my fitness to participate.

Emergency Medical Authorization

In the event of an accident, illness, injury, or emergency situation, I authorize Grasp the Adventure and its representatives to arrange, seek, or obtain emergency medical treatment on my behalf if deemed necessary.



I understand that any medical treatment, evacuation, transportation, rescue, hospitalization, or related expenses incurred are solely my responsibility.

Photography & Media Consent

I grant Grasp the Adventure LLC permission to photograph, film, record, or otherwise capture my image, voice, likeness, and participation during any activity.

I authorize Grasp the Adventure LLC to use such photographs, videos, recordings, and other media for marketing, promotional, educational, commercial, social media, website, and advertising purposes without compensation or further approval.

Release & Indemnity

I hereby release, waive, discharge, and hold harmless Grasp the Adventure LLC, its directors, employees, contractors, volunteers, guides, activity leaders, affiliates, sponsors, and representatives from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising from or related to my participation in any activity, including those resulting from negligence to the fullest extent permitted by law.

I agree to indemnify and hold harmless Grasp the Adventure LLC against any claims, damages, costs, or legal expenses arising from my actions, conduct, negligence, or failure to comply with safety instructions.

Severability

This agreement shall be binding to the fullest extent permitted by applicable law.

If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Participant Acknowledgement

I HAVE READ THIS RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT. I FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I MAY BE GIVING UP CERTAIN LEGAL RIGHTS BY AGREEING TO IT, AND I AGREE FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT

Cancellation & Refund Policy

1. Local Hikes & Day Adventures

At Grasp the Adventure, we understand that plans can change. Participants may cancel their booking up to 72 hours before the scheduled adventure.

For cancellations made more than 72 hours before the adventure, a refund will be issued minus a 5% processing fee to cover payment gateway and administrative costs.

No refunds will be issued for cancellations made within 72 hours of the adventure.

Participants may transfer their booking to another eligible participant, subject to prior approval by Grasp the Adventure LLC.

2. International Adventures & Special Events

International adventures, overseas expeditions, training courses, climbing programs, and selected special events operate under event-specific cancellation policies due to supplier commitments, accommodation bookings, transportation reservations, permits, and other advance costs.

The cancellation and refund policy applicable to each international adventure or special event will be clearly stated on the event registration page and forms part of these Terms & Conditions.

By completing a booking, participants acknowledge and accept the cancellation policy specific to that adventure or event.

3. Event Changes, Postponements & Cancellations

Grasp the Adventure LLC reserves the right to modify, postpone, reschedule, or cancel any event due to weather conditions, safety concerns, insufficient participant numbers, government restrictions, force majeure events, natural disasters, or any circumstances beyond its reasonable control.

Where an event is cancelled by Grasp the Adventure LLC, participants will be offered either:

  • A full refund; or
  • A credit towards a future event

Refunds shall not include any third-party expenses incurred by participants, including but not limited to flights, visas, accommodation, transportation, insurance, equipment purchases, or other personal expenses.

4. No-Show Policy

Participants who fail to attend an event without prior notice will be considered a no-show and will not be eligible for any refund, credit, transfer, or rescheduling.
